An article written by Gunster attorneys David Scileppi and Gus Schmidt was published recently in the Daily Business Review. It was published as a “Board of Contributors” commentary.

In “Changes to how companies raise capital are significant,” published on October 2 in the DBR, the attorneys write that the ban against general solicitation and advertising that was lifted September 23 has changed the landscape for companies seeking to raise capital.

Companies with certain private offerings of securities, under revised “Rule 506” of Regulation D of the Securities Act of 1933, are now able to advertise as long as certain other criteria are met.

Scileppi is a shareholder and co-leader of Gunster’s securities and corporate governance practice. Schmidt is an associate in the firm’s banking, corporate and securities practices.
