The civil tax summonses for Miccosukee Indian tribe records at four different financial institutions have been upheld by a federal appeals court, according to an article published in the Daily Business Review on October 16. The summonses were issued by the Internal Revenue Service in 2010, but the tribe sought to invalidate them on claims of tribal sovereign immunity, the article states.

Martin Press, an attorney in Gunster’s Fort Lauderdale office and who is Board Certified in Taxation Law by the Florida Bar, indicated the ruling was not surprising, saying that tribes can’t have it both ways, claiming sovereignty while selling to the public.
