Upon bringing AOB issues to the Florida Supreme Court, there has been a debate whether or not written consent should be required from both from the insureds and policy holders in order to validate a claim. In the article, Bell discusses AOB issues that have arisen due to the split decision from Florida’s intermediate appellate courts. In his explanation, he works to outline the request to amend policy language that restrict the ability of policy holders to assign post-loss benefits.
Bell co-chairs Gunster’s firmwide appellate law practice where he focuses on civil appeals and trial support. He is a former Florida Supreme Court Justice, serving from 2002-2008.
