On March 23, 2022, Gunster Shareholder Eric Olsen will speak at the Florida Association of Environmental Professionals Southwest Chapter lunch and learn program. Eric will provide insight on the Florida Department of Environmental Protection’s State Assumed 404 permitting program, and Gunster Shareholder Debbie Madden will also participate in the presentation.
Gunster’s team has assisted in obtaining State Assumed 404 permits for projects all over Florida, including southwest Florida. This training will explain this wetland permitting program, outline how applications move through the permitting process, cover how to meet the permitting criteria, and instruct on how to avoid pitfalls such as EPA objections to the public notice. The training will also focus on recent developments affecting the State Assumed 404 permitting program including EPA’s new Waters of the United States rulemaking and Corps’ recent announcement to not honor approved jurisdictional determinations obtained under the Navigable Waters Protection Rule. Finally, the training will describe actions to best move your permit application forward.
Inside and outside of Florida, Eric T. Olsen assists myriad business and individual clients on environmental law and regulatory matters. A Florida native, for nearly three decades Eric has focused his practice on wetland regulation, mitigation banking, stormwater regulation, consumptive use or water use permitting, water supply and underground injection control. Beginning as a St. Johns River Water Management District in-house attorney, Eric worked with other water management districts to develop the Environmental Resource Permitting program, statutes and rules governing wetland mitigation banks, and rules and policies affecting water supply and water use. He was also involved in evaluating permit applications and resolving enforcement issues.
Deborah K. Madden represents a broad range of clients, including developers, agricultural interests and public and private companies. She has experience providing legal support to clients in permitting and litigation matters involving water resources, wetlands, water supply, state and federal listed species issues, mitigation banking, state submerged lands and coastal construction. She represents clients in court proceedings and before administrative law judges on a variety of environmental permitting, compliance and regulatory claims issues.
