Gunster Attorney Justin Shifrin authored an article that was published in the Winter 2023 issue of the Florida Bar's ActionLine magazine, titled "Diminished Capacity Resolving Diminished Clarity."

In the article, Shifrin highlights how the new Florida Rule 4-1.14 pertaining to diminished capacity has been revised to align very closely with the longstanding ABA Model Rule 1.14.

"Florida lawyers may take refuge in the clarifications provided by the revised Rule 4-1.14. They may rest assured that their licenses are not on the line for taking or not taking protective action for clients who possibly suffer from diminished capacity," Shifrin concludes.
