The Jan. 5 profile discusses Press' involvement in three of the year's most talked-about tax cases in 2014:
- U.S. v. Clarke – The U.S. Supreme Court ruled that taxpayers who provide a plausible inference of bad faith on the part of the IRS may get an evidentiary hearing in a summons enforcement case. - Dynamo Holdings v. Commissioner – Tax Court ruled that taxpayers may use computer-assisted document review when responding to discovery requests by the IRS.
- U.S. vs. Zwerner – Although a jury upheld a $2.2 million penalty against defendant for willful failure to disclose foreign bank account reports, the case settled before questions of an excessive penalty under the Eighth Amendment could be addressed, Press told the Tax Analyst writer.
