Gunster Shareholder and Tampa Office Managing Shareholder, Bill Schifino Jr., was recently quoted in the Business Observer regarding a lawsuit brought against Physician Partners of America LLC (PPOA) by Surgery Center Holdings Inc. In dispute was whether PPOA and another physician in the company could keep patients who joined their practice if the doctors who brought them were violating a noncompete agreement by working for PPOA.
The case underscores the importance of adhering to noncompete agreements. "The case was one that we, in the end, would have clearly won," Schifino explained, "but litigation is very expensive, and so we made a decision ... in the best interests of the patients."
William Schifino Jr. is managing shareholder of the firm’s Tampa office and is a board certified specialist in the area of business litigation.
