Gunster Shareholder Jonathan Osborne, who co-chairs the firm's White Collar Defense & Internal Investigations practice, recently authored an article for Daily Business Review regarding "5 Steps for Responding to an AG Investigation."
In the article, Jonathan highlights price gouging and consumer protection laws (the Florida Deceptive and Unfair Trade Practices Act), both of which are enforced by the Office of the Florida Attorney General. These investigations carry harsh potential penalties and fine exposure; therefore, it is imperative to be prepared, including by engaging counsel and preserving relevant materials. "Your counsel should conduct an internal investigation to evaluate the facts—review the relevant documents, analyze your contracts with consumers, and interview the employees involved," he advises.
