On April 16, the SEC announced a new, streamlined procedure to seek extensions of previously granted confidential treatment requests. Following the previously announced disclosure reforms under the 2015 Fixing America’s Surface Transportation Act, or “FAST” Act, the SEC has developed a one-page application to extend the period for confidential treatment without the need to refile the unredacted documents or to resubmit the analysis supporting continued confidential treatment, so long as the original analysis remains the same.
If you have any questions on the new procedure, please contact Gunster securities law and corporate governance practice leader Bob Lamm.
