A member of Gunster’s Real Estate Group, Fernando Diaz focuses on land use, environmental permits, compliance, litigation, and enforcement defense. Experienced in transactions, compliance, and litigation, he brings a 360-degree perspective in helping clients mitigate and resolve environmental risks and disputes.
Clients rely on Fernando for guidance regarding the complex environmental issues that arise in transactions. He advises clients on risk allocation, environmental due diligence, provisions in purchase, sale and financing agreements, and environmental insurance. He also helps clients with annexations, site plans, comprehensive plan amendments, rezonings and large-scale master plan approvals.
Fernando strives to be a trusted resource for clients in environmental compliance and contamination matters, including remediation, enforcement defense and litigation. He has helped clients across the country on matters arising under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), Clean Water Act, Clean Air Act, Resource Conservation and Recovery Act (RCRA), Endangered Species Act, National Environmental Policy Act and Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). He also has significant experience related to per- and polyfluoroalkyl substances (PFAS) regulatory compliance and contamination issues.
Fernando represents clients before federal, state, county and local regulators. Well-versed in the many federal and state environmental laws impacting businesses, properties, property owners and tenants, he has also played a role in representing clients before the United States Environmental Protection Agency, the Department of Justice, and state regulators, including planning, land use and zoning boards, architectural review boards, historic preservation boards, municipal councils, and county commissions.
Fernando’s clients are in a variety of industries and sectors, including energy, manufacturing, agriculture, retail, consumer products, chemical, industrial transport and logistics, telecommunications, real estate and private equity.

- Advised a multinational managed healthcare and insurance company regarding environmental aspects of its acquisition in a deal valued in excess of $600 million.
