The U.S. patent system will go from a “first to invest” standard to a “first to file” standard, effective March 2013, Gunster attorney Bob White recently told Florida Small Business, a Florida Trend publication.
White, a shareholder practicing in technology, corporate and securities law in Fort Lauderdale, says the new legislation known as the Leahy-Smith America Invents Act is the most fundamental change to the system in years.
Speed and focus will be essential for companies large or small who wish to navigate the time-consuming and expensive patent process, especially in highly technical fields such as biotech and pharmaceuticals.
