The Jacksonville Business Journal reached out to John G. Metcalf, a shareholder in Gunster’s environmental & land use and real estate practices, for his opinion on an impact fee class-action dispute against the city of Fernandina Beach.

“The point of the impact fee is to try to mitigate the impact that the person or business having,” Metcalf told reporter Christian Conte.

The ongoing litigation involves the City of Fernandina charging residents water and sewer impact fees under the term “futures,” which plaintiffs say make it difficult to stay in business.

Impact fees are for when there is an actual impact caused by development, Metcalf told the Journal, and they must be used for capital expenditures not for operating costs. Metcalf is not involved in the Fernandina Beach case.
