Aaron Jay Horowitz is a Shareholder in Gunster’s Fort Lauderdale office. He is a litigator and serves as Chair of the firm’s statewide Dispute Resolution Practice Group.

Aaron litigates complex legal disputes for businesses and individuals. He concentrates his practice in the areas of business litigation, real estate litigation, employment litigation, intellectual property litigation and estate and trust litigation. In addition to litigating at the trial court level, Aaron has also represented clients in appellate proceedings before state and federal courts, including the United States Supreme Court. He is a member of the Board of Directors of the Broward County Bar Association, where he serves as Chair of the Business Law Section.

Aaron’s business clients have ranged from Fortune 100 companies to start-ups across diverse industries, and include national and local banks, land developers, pharmaceutical companies, defense contractors, automobile manufacturers and dealers, construction and engineering firms, accounting and law firms, wealth management firms, universities, luxury goods manufacturers, consumer product manufacturers, software developers, cloud computing service providers, internet marketers, agricultural and food producers, gaming and entertainment companies, hotels and beach resorts. In his estate and trust litigation practice, Aaron represents trustees, personal representatives, curators and beneficiaries in high-asset fiduciary disputes.

He is a Florida Supreme Court Certified Circuit Civil Mediator, Certified Appellate Mediator and Qualified Arbitrator, and he serves as Chair of the Business, Employment and Real Estate Disputes Committee of the Florida Bar’s 1,100-member Alternative Dispute Resolution Section, where he also serves on the Executive Council.

Aaron was selected to the Best Lawyers in America List for Commercial Litigation, as a "40 Under 40" by the South Florida Business Journal, and as a “Top 40 Under 40” by The National Trial Lawyers. He has also received honors and awards from the Florida Bar, Florida Trend magazine, Super Lawyers and the South Florida Legal Guide.

Aaron earned his B.S.B.A. in Decision and Information Sciences, summa cum laude, from the University of Florida. Following his undergraduate studies, he obtained his Juris Doctor, magna cum laude, from the University of Florida Levin College of Law. A South Florida native, Aaron is active in the community and serves in leadership roles for local professional and nonprofit organizations.

  • Represented international entertainment company in $129 million bid to acquire multiple pari-mutuel facilities involved in litigation with lenders
  • Represented boutique hotel in arbitration against co-tenant in real property partition action seeking $23 million in unjust enrichment damages
  • Defended commercial property owner in accounting, appraisal and breach of fiduciary duty action brought by shareholder seeking $14 million in damages
  • Represented shareholder in litigation against publicly-traded energy drink manufacturer for violations of the securities exchange act, injurious falsehood, fraudulent inducement and breach of contract
  • Defended land owner in comprehensive plan consistency challenge concerning 7,600-acre parcel
  • Represented land developer in litigation against 101-acre community development district concerning assessments relating to $27 million construction and maintenance bonds
  • Represented surviving spouse in obtaining pretermitted spousal share of an estate with over $84 million in assets
  • Represented beneficiary in trustee removal and breach of fiduciary duty litigation concerning trusts with over $20 million in assets
  • Represented court-appointed fiduciary in disgorgement and surcharge litigation against prior trustees and personal representatives
  • Defended 900-acre beach resort in dispute with assignee of developer concerning entitlement to club membership rights
  • Represented cruise line stevedoring operation in breach of fiduciary duty litigation relating to sale of assets
  • Represented mortgage lender in multi-million dollar litigation against former branch manager concerning claims of Racketeer Influenced and Corrupt Organizations Act (RICO) violations, civil conspiracy, fraud, breach of contract, breach of fiduciary duty and tortious interference
  • Defended regional bank in Fair Labor Standards Act (FLSA) and Worker Adjustment and Retraining Notification Act (WARN) litigation brought by dozens of former employees who sought over $8 million in damages
  • Defended database software company in multi-million dollar breach of contract disputes with customers in several states
  • Represented manufacturer of environmentally sensitive products in patent infringement and false advertising litigation with competitor
  • Represented international luxury sink and faucet manufacturer in trademark and unfair competition dispute against Florida competitor
  • Defended state-chartered bank in patent infringement action relating to online banking and account management services
  • Represented boat builder in replevin and conversion action concerning transfer of design rights for proprietary boat molds
  • Represented former shareholder in action against explosion mitigation corporation for securities fraud, fraud in the inducement, breach of statutory duties and negligent misrepresentation concerning sale of shares
